I don't know about writing a PHY driver, but that chip isn't a PHY;
it's a transfomer. http://www.taimag.com/Products/LAN-IH.htm
According to the re(4) manpage, the 8169S has a built-in PHY. Try adding
rgephy to your kernel config.
