TLP driver in generic

I've just noticed that the GENERIC kernel is still configured to use the 
TLP ethernet driver (and this includes 1.6.1 sources).  On my machine this 
*just does not work*.

Has anyone else managed to get this driver working on a Cats?  If not, why 
haven't we rolled by to the de driver which does work?

It's daft that we are shipping kernels with a known broken driver.
