This isn't really a kernel development issue, so I'll answer...

BeOS is case insensitive. It always will be.

Those files have to be named like that for source compatibility - some
people use a capital O there, some don't.

Checking out on Windows may fail, but the fact that the tree doesn't
and probably never will build on Windows negates that being a problem
