I experienced this problem (scenario 2) on an LC575, running
OpenBSD 2.9. The problem does not exist in the (significantly)
updated code of NetBSD 1.6, and something is mentioned of this
problem on the NetBSD site, somewhere.

So, the bug is real, and seems to be fixed in NetBSD 1.6.
