As a r= esult, there was little room to raise concerns about the possible excesses = or dangers of the American reaction, let alone to dissent from what politic= al leaders were proposing in the name of vengeance and security. The psycho= logical trauma from the carnage and the wreckage at the country=E2=80=99s m= ost cherished symbols swamped rational faculties and thus rendered futile a= ny attempts to urge restraint or caution.=C2=A0 Nonetheless, a few tried. Scorn and sometimes worse were universally heaped= upon them.=C2=A0 On September 14 =E2=80=94 while bodies were still buried under burning rubb= le in downtown Manhattan =E2=80=94 Congresswoman Barbara Lee=C2=A0cast a lo= ne vote=C2=A0against the Authorization to Use Military Force (AUMF). =E2=80= =9CSome of us must urge the use of restraint,=E2=80=9D she said seventy-two= hours after the attack, adding: =E2=80=9Cour country is in a state of mour= ning=E2=80=9D and thus =E2=80=9Csome of us must say: let=E2=80=99s step bac= k for a moment, let=E2=80=99s pause just for a minute, and think through th= e implications of our actions today so that this does not spiral out of con= trol.=E2=80=9D=C2=A0 For simply urging caution and casting a single =E2=80=9Cno=E2=80=9D vote ag= ainst war, Lee=E2=80=99s Congressional office was deluged with threats of v= iolence. On the le= ft, people like Susan Sontag and Noam Chomsky, and on the right people such= as Ron Paul and Pat Buchanan =E2=80=94 in different ways and at different = times =E2=80=94 urged U.S. politicians and Americans generally to resist un= leashing an orgy of domestic assaults on civil liberties, foreign invasions= , and an endless war posture. They warned that such a cycle, once initiated= , would be very difficult to control, even more difficult to reverse, and v= irtually guaranteed to provoke even greater violence.=C2=A0 These few who dissented from the instant consensus were, like Congresswoman= Lee, widely vilified. Both Sontag and Chomsky were=C2=A0branded=C2=A0anti-= American Fifth Columnists, while David Frum,=C2=A0writing in=C2=A0National = Review, denounced Buchanan and others questioning the excesses of the War o= n Terror from the right as =E2=80=9CUnpatriotic Conservatives=E2=80=9D: no = different, proclaimed the neocon, than =E2=80=9CNoam Chomsky, Ted Rall, Gor= e Vidal, Alexander Cockburn, and other anti-Americans of the far Left.=E2= =80=9D | | | | David Frum,=C2=A0National Review, Mar. 25, 2003 In retrospect, it is hard to deny that those who defied, or at least questi= oned, the potent 2001 emotional consensus by urging deliberation in lieu of= reactionary rage were vindicated by subsequent events: the two-decade expa= nsion of the war in Afghanistan to multiple countries, the enactment of the= Patriot Act, the secret implementation of mass surveillance systems, the t= rillions of dollars of taxpayer wealth transferred to weapons manufacturers= , and the paramilitarization of the domestic security state. At the very le= ast, basic rationality requires an acknowledgement that when political pass= ions and rage-driven emotions find their most intense expression, calls for= reflection and caution can only be valuable even if ultimately rejected. Yesterday=E2=80=99s invasion=C2=A0of the Capitol by a Trump-supporting mob = has certainly generated intense political passion and pervasive rage. It is= not hard to understand why: the introduction of physical force into politi= cal protest is always lamentable, usually dangerous, and, except in the rar= est of circumstances that are plainly inapplicable here, unjustifiable. It = was foreseeable that an action of this type would result in deaths. The mos= t surprising outcome is that =E2=80=9Conly=E2=80=9D four people died: an un= armed woman, a Trump supporter and Air Force veteran, who was shot in the n= eck by a law enforcement officer, and three other protesters who died from = unspecified =E2=80=9Cmedical emergencies=E2=80=9D (one reportedly died due = to accidentally tasering himself, inducing a heart attack). The U.S. Capitol remains a potent and cherished symbol even for Americans w= ho are deeply cynical about the ruling class and political system. Its nobi= lity is something continually engrained deep into our collective psyche sin= ce childhood, and that meaning endures even when our rational faculties rej= ect it. It is therefore not hard to understand why watching a marauding ban= d of hooligans invade and deface both the House and the Senate, without any= identifiable objective other than venting grievances, reflexively engender= s a patriotic disgust across the political spectrum.=C2=A0 It is unhinged to the point of being obscene to compare yesterday=E2=80=99s= incursion to the 9/11 attack or (as Sen. Chuck Schumer=C2=A0did last night= ) to Pearl Harbor. By every metric, the magnitude and destructiveness of th= ose two events are in an entirely different universe. But that does not mea= n there are no applicable lessons to be drawn from those prior attacks.=C2= =A0 Share One is that striking at cherished national symbols =E2=80=94 the World Trad= e Center, the Pentagon, the Capitol =E2=80=94 ensures rage and terror far b= eyond body counts or other concrete harms. That is one major reason that ye= sterday=E2=80=99s event received far more attention and commentary, and wil= l likely produce far greater consequences, than much deadlier incidents, su= ch as the=C2=A0still-motive-unknown=C2=A02017 Las Vegas mass shooting that = killed 59 or the 2016 Orlando shooting that left 49 dead at the Pulse night= club. Unlike even horrific indiscriminate shooting sprees, an attack on a s= ymbol of national power will be perceived as an attack on the state or even= the society itself. There are other, more important historical lessons to draw not only from th= e 9/11 attack but subsequent terrorism on U.S. soil. One is the importance = of resisting the coercive framework that demands everyone choose one of two= extremes: that the incident is either (a) insignificant or even justifiabl= e, or (b) is an earth-shattering, radically transformative event that deman= ds radical, transformative state responses.=C2=A0 This reductive, binary framework is anti-intellectual and dangerous. One ca= n condemn a particular act while resisting the attempt to inflate the dange= rs it poses. One can acknowledge the very real existence of a threat while = also warning of the harms, often far greater, from proposed solutions. One = can reject maximalist, inflammatory rhetoric about an attack (a War of Civi= lizations, an attempted coup, an insurrection, sedition) without being fair= ly accused of indifference toward or sympathy for the attackers. Indeed, the primary focus of the first decade of my journalism was the U.S.= War on Terror =E2=80=94 in particular, the relentless erosions of civil li= berties and the endless militarization of American society in the name of w= aging it. To make the case that those trends should be opposed, I frequentl= y argued that the threat posed by Islamic radicalism to U.S. citizens was b= eing deliberately exaggerated, inflated and melodramatized.=C2=A0 I argued that not because I believed the threat was nonexistent or trivial:= I lived in New York City on 9/11 and remember to this day the excruciating= horror from the smell and smoke emanating throughout Lower Manhattan and t= he haunting =E2=80=9Cmissing=E2=80=9D posters appended by desperate familie= s, unwilling to accept the obvious reality of their loved ones=E2=80=99 dea= ths, to every lamp post on every street corner. I shared the same disgust a= nd sadness as most other Americans from the Pulse massacre, the subway bomb= ings in London and Madrid, the workplace mass shooting in San Bernardino. My insistence that we look at the other side of the ledger =E2=80=94 the co= sts and dangers not only from such attacks but also the =E2=80=9Csolutions= =E2=80=9D implemented in the name of stopping them =E2=80=94 did not come f= rom indifference towards those deaths or a naive views of those responsible= for them. It was instead driven by my simultaneous recognition of the dang= ers from rights-eroding, authoritarian reactions imposed by the state, part= icularly in the immediate aftermath of a traumatic event. One need not enga= ge in denialism or minimization of a threat to rationally resist fear-drive= n fanaticism =E2=80=94 as Barbara Lee so eloquently insisted on September 1= 4, 2001.=C2=A0 Human memories are usually short and the dominance of social media has abri= dged them even further. Many have forgotten that the Clinton administration= seized on the 1995 courthouse bombing in Oklahoma City to radically expand= law enforcement powers and=C2=A0escalate its demands=C2=A0for full-scale b= ackdoor access to all encrypted internet communications. The fear necessary= to justify such draconian measures was fueled by incessant=C2=A0media hypi= ng=C2=A0of weekend citizen militias in places like Idaho and Montana said t= o be plotting armed insurrection against the federal government.=C2=A0 One of the first major War on Terror attacks on core Constitutional rights = which I=C2=A0wrote about=C2=A0was Newt Gingrich=E2=80=99s=C2=A02006 speech= =C2=A0suggesting that the First Amendment=E2=80=99s free speech guarantee t= o fight terrorism should be =E2=80=9Cmodified=E2=80=9D.=C2=A0 | | | | The former House Speaker approvingly cited=C2=A0a=C2=A0Commentary=C2=A0arti= cle=C2=A0by former federal prosecutor Andrew McCarthy =E2=80=94 entitled = =E2=80=9CFree Speech for Terrorists?=E2=80=9D =E2=80=94 insisting that some= ideas are so dangerous, especially in the era of terrorism and the interne= t, that the First Amendment must be limited to permit greater censorship po= wers: With an enemy committed to terrorism, the advocacy of terrorism=E2=80=94the= threats, the words=E2=80=94are not mere dogma, or even calls to =E2=80=9Ca= ction.=E2=80=9D They are themselves weapons=E2=80=94weapons of incitement a= nd intimidation, often as effective in achieving their ends as would be fir= earms and explosives brandished openly. . . .=C2=A0 Do we so lack confidence (except in the sacrosanct status of speech itself)= that we are unable to say with assurance that some things are truly evil, = and that advocating them not only fails to serve any socially desirable pur= pose but guarantees more evil? Must our historical deference to opinion, ho= wever noxious, defer as well to a call to arms against innocents, or a call= to destroy a form of representative government that=C2=A0protects=C2=A0rel= igious and political freedom? May we not even ban and criminalize the advoc= acy of militant Islam and its m=C3=A9tier, which is the indiscriminate slau= ghter of civilians? . . .=C2=A0 In America's bumptious, bounteous marketplace, there are no limits on words= as the building blocks of ideas, or on ideas as the legitimate instruments= of persuasion. Terror has no place in such discourse. It is the function o= f law to express our society's judgments. Ours should be simple and humane:= words that kill are not words we need abide. As a free speech advocate and civil libertarian, I was naturally repelled b= y this notion that some political ideas could be deemed so dangerous by the= state that they can be legally suppressed. In response, I=C2=A0asked rheto= rically in 2006: =E2=80=9CAre there=C2=A0any=C2=A0American values at all in= which Bush followers and neocons actually believe -- any constitutional pr= inciples that are sacrosanct and whose violations they would oppose if unde= rtaken in the name of fighting The Terrorists?=E2=80=9D I concluded: =E2=80= =9CIt certainly doesn't appear so.=E2=80=9D Beyond raising alarms about civil liberties erosions, I also often insisted= that the underlying causes of terrorism aimed at the U.S. should be consid= ered if for no other reason than to understand how to address it without de= stroying core liberties for Americans.=C2=A0 While religious fanaticism may sometimes be the cause, far more often, I ar= gued, such attacks were=C2=A0motivated by rage=C2=A0over the killing of inn= ocent people, including children, by the U.S. Government=E2=80=99s bombs, d= rones and tanks in Muslim-majority countries. Right-wing advocates=C2=A0oft= en demonized=C2=A0such arguments as pro-terrorist or as =E2=80=9Cjustifying= =E2=80=9D terrorist attacks, but the left largely supported the inquiry int= o motivating causes, just as they have long supported the attempts to under= stand what motivates violent crime, on the ground that misguided actions ar= e often driven by valid or at least widely shared redressible grievances. B= ut the view that we should attempt to identify the core motives of terroris= t acts or violent crime, rather than just label them evil and vow to destro= y their perpetrators, was largely deemed taboo in mainstream discourse. It is stunning to watch=C2=A0now as every War on Terror rhetorical tactic t= o justify civil liberties erosions is now being invoked in the name of comb= atting Trumpism, including the aggressive exploitation of the emotions trig= gered by yesterday=E2=80=99s events at the Capitol to accelerate their impl= ementation and demonize dissent over the quickly formed consensus. The same= framework used to assault civil liberties in the name of foreign terrorism= is now being seamlessly applied =E2=80=94 often by those who spent the las= t two decades objecting to it =E2=80=94 to the threat posed by =E2=80=9Cdom= estic white supremacist terrorists,=E2=80=9D the term preferred by liberal = elites, especially after yesterday, for Trump supporters generally. In so m= any ways, yesterday was the liberals=E2=80=99 9/11, as even the=C2=A0most s= ensible commentators=C2=A0among them are resorting to the most unhinged rhe= toric available. Within hours of the Capitol being cleared, we heard truly radical proposals= from numerous members of Congress. Senators and House members who objected= to Electoral College certification, or questioned its legitimacy, should b= e formally accused of sedition and=C2=A0expelled from the House=C2=A0if not= prosecuted, argued Rep. Cori Bush (D-MO), with other House members express= ing support. Even those unarmed protesters who peacefully entered the Capit= ol should, many argued, be hunted by the FBI as domestic terrorists.=C2=A0 Calls proliferated for the banning of the social media accounts of instigat= ors and protest participants. Journalists and politicians cheered the decis= ion by Facebook and Twitter to temporarily bar the President from using the= ir service, and then cheered again when Facebook=E2=80=99s CEO Mark Zuckerb= erg=C2=A0announced on Tuesday=C2=A0that the ban on Trump extended through B= iden=E2=80=99s inauguration. Some journalists, such as=C2=A0CNN=E2=80=99s O= liver Darcy,=C2=A0complained=C2=A0that Facebook had not gone far enough, th= at more mass censorship was needed of right-wing voices. The once-radical 2= 006 Gingrich argument =E2=80=94 that some opinions are too dangerous to all= ow to be expressed because they are pro-terrorist and insurrectionary =E2= =80=94 is now thriving, close to a consensus.=C2=A0 These calls for censorship, online and official, are grounded in the long-d= iscredited, oft-rejected and dangerous view that a person should be held le= gally accountable not only for their own illegal actions but also for=C2=A0= the consequences of their protected speech: meaning the actions others take= when they hear inflammatory rhetoric. That was the distorted mentality use= d by the State of Mississippi in the 1970s to try to hold NAACP leaders lia= ble for the violent acts of their followers against boycott violators after= hearing rousing pro-boycott speeches from NAACP leaders, only for the Supr= eme Court in 1982 to=C2=A0unanimously reject=C2=A0such efforts on the groun= d that "while the State legitimately may impose damages for the consequence= s of violent conduct,=C2=A0it may not award compensation for the consequenc= es of nonviolent, protected activity," adding that even "advocacy of the us= e of force or violence does not remove speech from the protection of the fi= rst amendment." That the only = person shot was a protester killed by an armed agent of the state by itself= makes clear how irresponsible these terms are. There are more adjectives b= esides =E2=80=9Cfascist treason=E2=80=9D and =E2=80=9Charmless protest,=E2= =80=9D enormous space between those two poles. One should not be forced to = choose between the two. | | | | It has long been clear that, in the post-Trump era, media outlets looking t= o keep viewers hooked, and government officials looking to increase their p= ower, will do everything possible to center and inflate the threat posed by= right-wing factions. I=E2=80=99ve said this more times than I can count ov= er the last year at least. Like all inflated threats, this one has a kernel of truth. As is true of ev= ery faction, there are right-wing activists filled with rage and who are wi= lling to engage in violence. Some of them are dangerous (just as some Musli= ms in the post-9/11 era, and some Antifa nihilists, were and are genuinely = violent and dangerous). One is the importance of resisting the coercive framework that demands e= veryone choose one of two extremes: that the incident is either (a) insigni= ficant or even justifiable, or (b) is an earth-shattering, radically transf= ormative event that demands radical, transformative state responses. <= /p><p style=3D"color:#1a1a1a;font-size:16px;line-height:26px;margin:0 0 1em= 0;">This reductive, binary framework is anti-intellectual and dangerous. Those who spent the sum= mer demanding the police be defunded are furious that the police response a= t the Capitol was insufficiently robust, violent and aggressive. Those who = urged the abolition of prisons are demanding Trump supporters be imprisoned= for years. Those who, under the banner of =E2=80=9Canti-fascism,=E2=80=9D = demanded the firing of a top <em>New York Times </em>editor for p= ublishing an op-ed by Sen. Tom Cotton (R-AR) advocating the deployment of t= he U.S. military to quell riots =E2=80=94 a view deemed not just wrong but = unspeakable in decent society =E2=80=94 are today furious that the National= Guard was not deployed at the Capitol to quash pro-Trump supporters. Antif= a advocates are working to expose the names of Capitol protesters to empowe= r the FBI to arrest them on terrorism charges. And while Rep. One need not dismiss the lamentable actions of yesterday to simult= aneously reject efforts to apply terms that are plainly inapplicable: = <em>attempted coup, insurrection, sedition</em>. There was zero chance that= the few hundred people who breached the Capitol could overthrow the U.S. G= overnment =E2=80=94 the most powerful, armed and militarized entity in the = world =E2=80=94 nor did they try. </p><p style=3D"color:#1a1a1a;font-s= ize:16px;line-height:26px;margin:0 0 1em 0;">Perhaps many view it as more u= psetting to see august members of Congress hiding in fear of a riot than to= watch ordinary small-business owners weep as their multi-generational stor= e burns to the ground. Undoubtedly, national reporters who spend much time = in the Capitol and who have long-time friendships with Senators and House m= embers are more horrified, far more so, by violent gangs in the Capitol rot= unda than on the streets of Portland or Kenosha. But that does not mean tha= t rational restraint is unnecessary when searching for sober language to ac= curately describe these events. </p><p style=3D"color:#1a1a1a;font-siz= e:16px;line-height:26px;margin:0 0 1em 0;">There is a huge difference betwe= en, on the one hand, thousands of people shooting their way into the Capito= l after a long-planned, coordinated plot with the goal of seizing permanent= power, and, on the other, an impulsive and grievance-driven crowd more or = less waltzing into the Capitol as the result of strength in numbers and the= n leaving a few hours later. That the only person shot was a protester kill= ed by an armed agent of the state by itself makes clear how irresponsible t= hese terms are. There are more adjectives besides =E2=80=9Cfascist treason= =E2=80=9D and =E2=80=9Charmless protest,=E2=80=9D enormous space between th= ose two poles. I=E2=80=99ve said this= more times than I can count over the last year at least.</p><p style=3D"co= lor:#1a1a1a;font-size:16px;line-height:26px;margin:0 0 1em 0;">Like all inf= lated threats, this one has a kernel of truth. As is true of every faction,= there are right-wing activists filled with rage and who are willing to eng= age in violence. Some of them are dangerous (just as some Muslims in the po= st-9/11 era, and some Antifa nihilists, were and are genuinely violent and = dangerous). But as was true of the Cold War and the War on Terror and so ma= ny other crisis-spurred reactions, the other side of the ledger =E2=80=94 t= he draconian state powers clearly being planned and urged and prepared in t= he name of stopping them =E2=80=94 carries its own extremely formidable dan= gers. </p><p style=3D"color:#1a1a1a;font-size:16px;line-height:26px;ma= rgin:0 0 1em 0;">Refusing to consider those dangers for fear of standing ac= cused of downplaying the threat is the most common tactic authoritarian adv= ocates of state power use. Less than twenty-four hours after the Capitol br= each, one sees this tactic being wielded with great flamboyance and potency= , and it is sure to continue long after January 20.</p><div
