            The press
statement on the subject CPP protested
to SC on hearing of Memo Scandal as issued by the Central Secretariat of
the Communist Party of Pakistan (CPP) for the information of public, electronic
and print media is as under:- 

 

Communist
Party of Pakistan (CPP) strongly protested to the Supreme Court (SC) on the
hearing of Memo Gate Scandal and said that this hearing clearly interferes and
challenges the Executive Authority, which otherwise is guaranteed by the Constitution
of Pakistan, 1973.

 

The
hearing of Memo Gate by Supreme Court in hasty manners clearly shows the
partiality of Supreme Court and siding with Nawaz Sharif on this Memo is
against all the norms of justice specially in the presence of pending enquiry
of memo by the Parliamentary Committee of Senate and by the Government.

 

The
Central Chairman of CPP, Engineer Jameel Ahmad Malik said that if we compare
Memo Gate sin of Haqqani with the High Treason of Musharraf, it clearly
indicates and stipulates that the matter of Memo Gate Scandal as no comparison
at all with the case of High Treason.

 

But
surprisingly the SC is not hearing the case of High Treason filed by the
Communist Party of Pakistan against General Musharraf, which is pending for
decision since September 7, 2009 and on the other hand, a memo gate petition of
Nawaz Sharif, which was filed five days before in the SC has now been fixed for
hearing before nine bench members on December 1. 

 

Engineer
Jameel being himself petitioner in High Treason case against Musharraf strongly
protested on the hearing of memo gate. This shows the partiality of the Supreme
Court and it violates all the principles of justice - justice should not only be done, but should be seen to be done.

 

CPP
petition of High Treason against Musharraf has not been fixed till to date
inspite of several requests by him to SC, otherwise, the justice demands that
his Party petition of High Treason should have been fixed by hearing before
memo gate.

 

CPP
requested the Apex
  Court
for immediate fixation of his High Treason and Air Marshal Asghar cases on
priority basis and suspension of memo gate petition was also demanded in the
interest of justice.

 

He
said the Supreme Court after the resignation of Haqqani should have waited for
the final outcome of the Parliamentary Committee of the Senate and of the
Government decision and the fixation of this case has raised a numbers of
questions to common mind and this act of SC is neither appreciable nor
justified in the peculiar circumstances where the issue of memo or letter
either written by Haqqani or Mansoor Ijaz is yet to be decided. 

 

Engineer
Jameel said that the hasty fixing of hearing of memo gate by ignoring his
petition also discriminates the petitioner under Article 25 of the Constitution.
The sole reason of this discrimination by the Supreme Court is that Nawaz
Sharif represents the bourgeois class whereas the petitioner party represents
the downtrodden masses.

 

The
CPP Chairman said that instead of filing petition on memo gate by Nawaz Sharif,
Ishaq Dar and Khawaja Asif they should have filed petition of High Treason
against General Musharraf in Supreme Court but true fact is that neither Nawaz
Sharif, Ishaq Dar, Khawaja Asif nor their Pakistan Muslim League (N) is playing
any concrete and positive role against the trial of Musharraf except hollow
claims. 

 

It
may be recalled that the High Treason case, a copy of which is available on the
party website www.cpp.net.pk
is pending for hearing since September 7, 2009 against General Musharraf was filed in
Supreme Court by CPP through its party Central Chairman, Engineer Jameel Ahmad
Malik under Articles 6 and 184(3) of the Constitution.
