From yesterday's WSJ. If Trump can get the Supreme Court to simply delay
this ruling, he can then severely cripple mail-in voting and then send ICE
agents to select voting districts to disrupt in person voting. The
Democrats will buzz around, complain and count on the Supreme Court to "do
the right thing" as a member of the Paul Wellstone Democratic Club put it
to me. (It's possible that they will in this case, but does anybody want to
bet the house on it?) The union leadership will be silent out of cowardice
and complicity. The geniuses of the sectarian ultra left will be silent
because they cannot under any circumstances appear to be supporting the
capitalist Democratic Party. Maybe the soft left, like those in Tempest,

rt to
allow federal agencies to implement an executive order that would restrict
mail-in ballots and create lists of people deemed eligible to vote ahead of
the November midterms.

The order, which President Trump issued in March, seeks to insert the
executive branch into the supervision of federal elections. Many experts on
election law have questioned its legality because the Constitution gives
power over elections to states and Congress, not the president.

Democratic officials in 23 states and the District of Columbia sued to
challenge the order, arguing that it was unconstitutional, and that its
procedures could be abused and disenfranchise many eligible voters.

U.S. District Judge Indira Talwani, a Boston-based appointee of former
President Barack Obama, blocked the administration from enforcing the order

On Saturday, a panel of the First U.S. Circuit Court of Appeals denied the

the administration to file its emergency appeal with the Supreme Court.

The appeal didn=E2=80=99t focus on the legality of the executive order. Ins=
tead,
the administration argued that the states didn=E2=80=99t yet have a legal r=
ight to
challenge it in court.
