I have no strong opinion about the particular details, but it does
strike me as important that we follow both U.S. and Japanese law for
the Japanese wikipedia, at least insofar as Japanese law does not
conflict with our NPOV policies.

(There are plenty of cases where I would say that we should proceed in
defiance of local law, but only if NPOV is at stake.)

The reason for this is that we would like for jp.wikipedia to be
freely distributable in print, CD, web, etc. *in Japan* by Japanese
people and organizations.

I should add this: I know nothing about Japanese law, but it seems
really unlikely to me that the concerns listed are valid. Trademark
law, in general, doesn't serve as any sort of barrier to encyclopedic
reporting on something. We could easily put famous trademarks into
articles reporting on, let's say McDonald's, so long as we aren't
using the trademark in a way that might deceive people into thinking
that we are McDonald's, and so on like that.

But, I have no strong opinion, because I know nothing about Japanese
law. It is better to err on the side of caution until we are sure,
because maintaining the freely distributable quality of the encyclopedia
is a very strong value.
