In most jurisdictions, murder requires intent. As of the time I write this, I've seen nothing to support a claim that the intent was to kill Floyd. One thing that is obvious is that Floyd was subdued and no longer offering any resistance. What's more, he surely knew what could occur if he were to resist any further.
