The Justice Department is seeking to dismiss the felony case against David Hearn, an American Olympic canoeist from the 2000 Sydney Games, after admitting that the damage he was charged with causing at the Lincoln Memorial Reflecting Pool was never vandalism at all. In the filing, Pirro’s office admitted that the damage to the Reflecting Pool was “the result of flawed installation by the contractor,” not the work of a former Olympian who allegedly touched the water with his bare hands. The filing lays out what actually happened: the sealant lining the bottom of the pool started peeling “almost immediately” after a Virginia-based company, Atlantic Industrial Coatings, finished a renovation job.
