The Justice Department is seeking to dismiss the felony case against David 
Hearn, an American Olympic canoeist from the 2000 Sydney Games, after admitting 
that the damage he was charged with causing at the Lincoln Memorial Reflecting 
Pool was never vandalism at all.

DC US Attorney Jeanine Pirro’s office filed a motion Friday to dismiss the 
indictment, just weeks after Hearn pleaded not guilty on July 9 to a felony 
count of destruction of property over an alleged June 19 incident. In the 
filing, Pirro’s office admitted that the damage to the Reflecting Pool was “the 
result of flawed installation by the contractor,” not the work of a former 
Olympian who allegedly touched the water with his bare hands.

The filing lays out what actually happened: the sealant lining the bottom of the 
pool started peeling “almost immediately” after a Virginia-based company, 
Atlantic Industrial Coatings, finished a renovation job. That company landed the 
work through a no-bid contract, and the rushed timeline appears to be part of 
the problem: the renovation was hurried through so it would be finished in time 
for the America 250 celebrations around Independence Day.

The real reason they're dismissing, apart from the fact Heard would have been 
acquitted, is that DOJ destroyed evidence.
