Indeed.  I either heard the same story, or a similar one.

Focus is pretty moribund.  I'm thinking of a high-value item.

Because there are serious unanswered questions about its status with 
regard to IBM's intellectual property, and it is quite obviously 
being used as a vehicle to enable piracy.  The intention of the 
creators and their avowed purpose are irrelevant - post after post, 
here and elsewhere, deomstrates that people are running licensed code 
under Hercules illegally.

When people start running ca. 30 MIPS systems using DB2 ad Websphere, 
IBM is losing revenue.  As the implementation of ESAME becomes more 
complete and the Intel performance curve advances, we'll be looking 
at 100 MIPS by the end of next year.

IBM has quite clearly stated that they will not issue licenses for 
their commercial software under Hercules.  Yet SHARE is actively 
engaged in distributing a system that - in this context - can ONLY be 
used to damage IBM's revenues.

Wonderful it might be.  Distilling your own booze is also wonderful - 
but illegal.
