Sam,

Go to the ISX web page you cite and look at their patent (6,530,078).  I 
don't think the case for Hercules running on IBM hardware  is 
strengthened by referring to a piece of emulation software,  the patent 
to which  references a number of recent IBM patents, which are probably 
licensed for use within the ISX product.
