This is the entire issue that TurboHercules and others are addressing in 
the EU legal system.  Your position is mostly a U.S. perspective, maybe 
even IBM's perspective.  Your statement is really an allegation.  The 
legal system in EU will determine if that is a fact.

If so compelled, it will likely not happen without some conditions, a 
compromise as some have suggested.  Those conditions could easily 
require the licensing of some IBM intellectual property to TurboHercules 
that requires object-code only implementation.  It is for this reason 
that I am a strong advocate for the ability to provide externally driven 
support and the appropriate hooks in Hercules to allow this to occur.  
While the exact nature of what migh be required is unclear, having a 
framework into which it could be accommodated gets you ahead of the game.

I have been in this situation personally where IBM and the company with 
whom I was employed ended up in court.  They ultimately settled out of 
court, but my company did end up licensing intellectual property from 
IBM and segregating IBM's products from our developers.
