I looked up this patent application on the USPTO PAIR website. The bad news
is that it is too late to submit 3rd party prior art. The good news is that
it was abandoned in 2010 and will never mature into a patent. Had it been
issued, there is also a new post-grant review procedure to challenge it, but
that also has a time limit. I still think the best defense is a good offense
when it comes to patent rights. Hercules needs to proactively file its own
applications to really gain any leverage/protection.

I see that the USPTO has just opened its new Third Party Prior Art
Submissions System. There is an article on (ahem) Groklaw describing
it.

Seems to me the first order of business should be to submit the
appropriate references from the Hercules lists as prior art for the
patent application US20070271307 "Write Sharing of Read-Only Data
Storage Volumes", which pretty much describes the Hercules shadow file
system.

Maybe it's too late - it's not clear to me, but someone (Ron?) who
knows The System might want to give it a go.
