Geertjan quoted the NetBeans Governance and Project Roles [1] page, which states: The Board has the high-level duty to ensure that the netbeans.org project is run in a fair and open manner. The Board exists as a last resort to resolve disputes and grievances. Although the second sentence is important, to me it seems like an implementation detail derived from the first (and more important) sentence. From my perspective, the board members *should* have a high-level duty to ensure the project is run in a fair and open manner. Don't you?
