I'm sorry but I find your complaint thoroughly flawed. First, you correctly 
point out that you 'can't just put up a disclaimer on my website stating "the 
use of my network" (including but not limited to HTTP, SMTP and DNS) 
signifies your acceptance of a $100 network access fee', then you imagine 
that somehow FreeNode require your permission to do a portscan. Am I the only 
person who finds this contradictory?

After all, a portscan and a 'legitimate' HTTP request are, in technological 
terms, exactly the same thing; transmission of arbitrary data. If your 
permission is required to do a portscan, then surely it is also required 
before I access your website? To put it another way, if I were to attempt to 
access via HTTP a server that turns out not to provide that service, would 
that constitute an unauthorised access?

I have similar levels of contempt for anyone who thinks that scanning for open 
smtp/nntp servrs constitutes a computer crime.
