I think this puts the hype around DVCS in perspective. Github et al. are run by companies trying to make money. Philanthropy is good advertising. BUT such a clause should be enough to deter anyone, especially in light of the recent licence discussion. As soon as anyone company waves a "software patent" suit at anyone on Github then you can expect to start paying. Plus, I don't believe in the legion of programmers out there bursting to help the project as soon as it gets hosted on "Platform X".
