I got my main problem solved by making a portable installation (miktex-portable-2.9.5987.exe). Now I can work with my tex-files.

a) Earlier I had a AV issue when I tried the net installer (Symantec end point protection)

I have tried the installation as an administrator (but not from the command prompt).

b) for now, I don't want to hassle any more when I got the portable installation working. (but still somewhat worried about dare I update MikTex or try to find out how to make it permanent)

This unfortunately only means that the executed process (initexmf.exe) failed (exit code 1). If the file C:\Users\fin7tsal\AppData\Local\Programs\MiKTeX
2.9\miktex\config\uninst.log is empty, I would try to run the same command as administrator manually from the console, maybe you would get more information this way (it worked for me, at least partially, the last time). I am not sure about mixed UNIX-like and MS-like path separators in the arguments (i.e. "\" vs. "/"), but Windows seems to be quite tolerant in this respect. 

Other than that, you may try to 

a) completely switch off your anti virus software and re-run the install; there have been reports of some AV software false positive alerts when processing some current MiKTeX packages,

b) generate the trace output (see http://www.miktex.org/diagnosing) and create a bug ticket
