CVSNT test with TortoiseCVS 12.x ("it is in the way")

We've discovered a bug (bug6021) in a few releases and a quick look at
the code indicates that it's probably in the CVSNT Community Release
2.5.05 too which is what TortoiseCVS 12.x uses. I wont bother testing
and fixing it in the Community release unless someone can reproduce it
and submits the results.
Can someone please run this test with TortoiseCVS 12.x (CVSNT 2.5.05
Client)
1. Checkout sandbox that has multiple levels and at least one file in
the 'top' level, eg:
cvs co fred
fred
fred\aaa.txt
fred\john
fred\john\blue.txt
fred\nancy
fred\nancy\red.txt
2. create a new files at more than one existing sub-directory, eg:
fred\john\new.txt and fred\nancy\newer.txt
3. cvs add all the new files
4. cvs commit ONLY ONE file from the 'top directory', eg:
fred\john\new.txt
cd c:\fred
cvs ci -m "" john\new.txt
5. cvs update the top directory, eg:
cd c:\fred
cvs update
Does this produce "it is in the way" errors?
Please submit a copy/paste of the TEXT from the TortoiseCVS progress
dialog showing the error. If possible please indicate the version of
CVS or CVSNT server you are using.
