The query you provide as an example seems to produce reasonable results
with a 3.2.0b6 install. If possible, you should try upgrading. I don't
recall the '&' problem specifically, but there were definitely some
problems with parsing of phrase searches in some of the older betas.
There are also a number of other known bugs in b5 that were fixed in b6.
