According to a website near-and-dear (http://www.oscommerce.org) they had this to say about open source code:

"Derived Works Modifications and derived works must be allowed, and must be distributed under the same terms as the license of the original software."

Linux sells an installer and services, but Red Hat Linux is free.

I'm not a lawyer, but I think that http://www.phpnukeservices.com/ 
is definately in breach of the open source agreement.
