Looking at the CVS I see "Zope 2.8 compatibility fixes" by "faassen"  
so I think that the problems have already been fixed in CVS but not  
in the last release.

The issue we had is that we were keen to avoid distributing a few  
thousand copies of our own release of FileSystemSite because it can  
cause confusion but it's not a big deal either way.
