I know this is getting off the topic and I apologize in advance, but what
law would be violated by discriminating against a green card holder? I know
there are laws against *some* types of discrimination (race, religion, some
others) but certainly not all discrimination is illegal.

It is common for there to be a general rule of "only job related issues may
be considered" but this is more of a safety (CYA) thing rather than a legal
thing. As I understood a few years ago from the H.R. attorney of the company
I worked for at the time that it was acceptable to hire only "non-smokers"
as smokers are not a protected group. Sounded a little strange to me at the
time but I saw no good argument to his statement.

Just curious if there have been some developments in HR that I have not
followed.

The ad says that they will not consider candidates requiring
sponsorship.    In my opinion, hiring H1 visa candidates in this kind of
market is a black letter violation of the H1 law, which clearly states that
H1 candidates cannot be hired unless qualified residents and citizens cannot
be found.  I actually respected that in this ad.

It is, however, illegal to discriminate against green card holders.  I can
understand that this may be a way of saying you require good English skills.
If that is the case, the ad needs to state English as a required skill.  If
a green card holder wants to apply and then sue for discrimination, they
certainly have an open door given the language in this ad.

This is my opinion based on many years hiring experience.  However, I am not
a lawyer and I certainly am not qualified to give legal advice.

unless it is a government job, I don;t doubt that not considering hiring
green card holders is an infraction to labor laws.
