Thanks for the tips. As another part of my research, I contacted a
lawyer at the Department of Justice who I consider to be
knowledgeable in this area, and I'll pass along what I learned from
her:
* She said there had been relatively little litigation on such
issues (so far).
* She also indicated that the Department's primary relevant policy
was still a paper published in November 2000, the "Guide for Federal
Agencies on Implementing Electronic Processes":

It addresses the legal principles and potential problems involved in
general terms, with reference to particular technologies or business
processes. I recommended this on its initial publication and it is
still a valuable reference to private sector businesses as well as
government agencies.
