Some very interesting comments have been posted here, but one thing I have
to disagree with is thinking of Amazon as a publisher. They are NOT the
publisher of works that are released in Kindle format - no more than Sony is
the publisher of books released in their format - no more than Fictionwise
is the publisher of books sold on their site - they do the conversion work
to put the books into many different formats for the person publishing the
work.
In all of this these cases - the company selling the product is acting as an
electronic 'printer', distributor and retailer - but not the publisher. The
publisher, whether it is a large company like Penguin, a small publisher
like Double-Dragon, a micro-press like WolfSinger Publications or a self
publisher, is the person submitted the book to Amazon.
Printers, like LSI and others are not generally considered responsible for
copyright issues in the product, most have that in their terms of service
and contracts, it is the publisher's responsibility to make sure the work
they are publishing is free of legal entanglements.
