Chris, whenever you do publish your great-grandfather's ms, I'd love to read
it!

Another problem is that scholarly publishers (like all publishers, I
imagine) have pretty strict rules about quoting from copyrighted works.  Not
being able to identify / locate the rights-holder means that you can't quote
from these works.  If you can't quote from them, you can't effectively use
them in your scholarship . . . or your teaching either.  Once I wanted to
assign a couple of chapters from a 1970s-era book to a college class.  The
campus bookstore refused to make copies available to students because the
author had retained rights (according to the copyright page) and he couldn't
be located.  That meant my students couldn't learn from what he wrote,
either.  I doubt that's the result that this author would have chosen, but
there you go.  (Maybe this last example is too recent be affected by the
Google settlement, but the problem would have been the same if I'd tried to
assign "The Hegira of the Hupp").
