Re: The Seven Types Of Pirate

Hello. I've been reading this thread (rope!) practically from the beginning. I've heard soothing words on difficult issues, and harsh words on everyday courtesy issues. This is really a deep and confusing part of the industry. I think I understand at least some part of both sides argument, and I would like to ask a question in general concerning the legality of downloading for back-up/ archiving purposes. Lets say that I have all ten books in a given series. I discover that all ten of those books are in ebook format. It doesn't matter which format. Obviously I wouldn't download a format my equipment didn't support. I discover that it's much more convenient to keep the ebook copies than it is the hardbooks. Let's say then that I give my hardbook copies away, keeping only the ebooks. Suddenly, my backup or archival copies aren't backups or archives....they are my sole copy. Now, if I understand correctly, I'm not a pirate. The author and publisher have
 both been paid.But, for what kind of time frame are we talking about here? A few issues are raised here, for instance, I suffer a hard drive crash and all of a sudden my primary ebook copy is gone. Am I a pirate if I download another copy? How long do I have to retrieve  a copy? Is there a time limit, or could you wait until you needed it? That leads up to another issue. I purchased a hard back copy of a book 12 years ago. Somehow, it's disappeared. Can I legitimately  download a replacement copy? As just about everyone has agreed at some point or another, it's a very large and confusing issue. Richard

Barry is feeling attacked. And I can't say that it's totally  

unwarranted. It's a pretty awful way to welcome a newish member who  

happens to disagree with the prevailing opinion here, even though  

there are other long term members here who are of nearly the same  

opinion. He stepped into the longest, hardest fought discussion we  

have: what is the exact nature of piracy/infringement and what should  

we/the law do about it? I suspect he didn't know what a wasp's nest he  

was getting into. And it took Chris and I rather longer than usual to  

jump into the fray, perhaps because we've been through this SO many  

times, and are tired of arguing the same old things when no one move  

an iota on either side. The law itself is evolving on ebooks. There is  

SO much that is not settled.



As Barry's arguments were well thought out, even if not everyone  

agrees, and I'd rather not see him leave in a huff, but if he wants  

to, we can hardly stop him. I, for one, think we are better off in  

having well-spoken, able-to-think readers here in addition to  

publishers and authors. YMMV.
