Some argue that case law permits it, but I really am foxed  by the idea that copyright law itself does.

I don't recognise this. A translation is not a copy, but a subsidiary right, as is audio. I'd really like to know your references for what you state. Financial gain surely relates to compensation issues. There is a lot more that is copyright than published material.
