My time was short, so i clearly missed this, Thanks for pointing it out. 
The EU is pretty hot in this area - though I don't think they have 
produced any strong legislation yet - so I probably took it for granted. 
I think Google has been trying to prepare for Chin's judgement by 
settling all other cases in order to argue their position more strongly. 
I'll try to get more facts on this one.

:-) Which is exactly what sharp operators rely on. And with so many new 
entrants in the small publishing area it is a bit like the fox and wolf 
with Pinocchio.  About the best I can do, when I get a chance, is to 
suggest it is not a good idea to put all one's eggs in one basket. Those 
in the business for the long haul do need to pay regard to the effects 
of the present on the future.
