If they were only passing along the info of customers based on which files
were found to be improperly shared, that might pass muster.

But this is how it is described...

"Customers will be informed that their data will be attached to the file
that they purchase and shared with the anti-piracy group at the point of
sale."

That implies that your data will be handed over because you purchased, not
because you shared.

I'm having a hard time imagining a *more* effective way to driving
customers away from legitimate purchases and towards anonymous downloads.

From a separate direction, the EU always provides the impression of fairly
strong privacy protections. At first glance, this would appear to violate
any reasonable expectation of customer privacy.
