They're putting up a fight because it's a time-honored tradition to play both sides of the fence, hoping to be allied with whomever comes out on top. If we go to war, they've projected the image of a strong nation unwilling to bow to the whims of a bullying administration, even if they ultimately assist in the campaign in hopes of getting a few million in post-Apocalypse rebuilding funds. If we don't go to war, they've projected the image of a nation so strong, it not only refused to bow to the whims of a bullying administration, it forced that administration to change its stance. Viva France. They're an independent country, and they're playing the same game we would. The European Union -- well, the Franco-German axis -- wants to take on the United States for dominance and relevancy, and this is a great issue on which to do it. It took a lot of effort to get them to update. ====================================================================== CANADA - In a clear incident of racial profiling, Berna Cruz, a Canadian Indian woman was subjected to a harrowing experience, when not one but five officers of the INS accused her of traveling with a fake passport at Chicagos O Hare airport on January 27. Its horrible. It was humiliating, said Cruz. What I felt was that it was total discrimination, racism. To add insult to injury Cruz was denied consular access, a phone call and threatened with jail. A cornered Cruz, desperate and in tears pleaded with the officers that her passport was genuine and that she had two children who were waiting for her in Canada. Cruz, who works as a loan officer in a Canadian Bank said that instead of listening to her pleas the officers, proceeded to rip off the front page of her passport and stamp expedited removal on each blank page rendering it ineffectual. Fingerprinted, photographed and barred from re-entering the US for five years, Cruz was removed to India and not Canada. Recounting her nightmarish experience Cruz said that on arriving at the OHare airport from Kuwait, an INS officer told her that her photograph on the passport looked funky. Subsequently she was sequestered in a room where other passengers were being checked. She noticed that another woman who spoke Punjabi was being meted out similar treatment. To her horror, Cruz noticed that all people in that room were of color. Cruz recounted that the INS officers became abusive when she insisted that her passport was real. It was a total abuse, Cruz said in an interview with the Star. I want to see them punished for this and bring some justice. This week, Cruz sent a letter, along with a sworn affidavit, and the INS removal documents to Prime Minister Jean Chrétien and Foreign Affairs Minister Bill Graham. The letter arrived at the Prime Ministers office yesterday, and staff had not had a chance to look into the story. But Foreign Affairs spokesperson Reynald Doiron confirmed yesterday that staff in Dubai issued Cruz an emergency passport and assisted in getting her home, via London. Were going to bring her case to the attention of the State Department in Washington, request an explanation on the INS refusal to grant at least one phone call to Ms Cruz, and well see what the American response is going to be, Doiron said last night. A full report is also expected from a Canadian official in Dubai and will be incorporated into the query that will be sent to the State Department, said Doiron. A spokesperson for the INS in Chicago said she needed time to look into Cruzs story but did say that officers have the authority to use expedited removals when passengers have no documents or are carrying documents that are suspected to be fraudulent or tampered with. We have very high-tech technology out there to detect these kinds of tampered documents, said Gail Montenegro. Also, any individual who expresses an interest in speaking with their consular official, we grant that. We do it over the phone. We do it all day. We do it any time that request is made. Montenegro said Cruz is welcome to file a complaint and that the INS takes complaints about officer conduct seriously. Cruz feels she was harassed because of the color of her skin. She says the INS officers humiliated her, and Canada, by refusing to allow her to contact Canadian authorities. Cruz was born in Trivandrum, India, and immigrated to Canada in 1994. Five years later, she became a citizen and traded in her Indian passport for a Canadian one. Her birthplace is noted in the passport, and its the same passport, she says, the INS officers suspected was a fake. An officer, says Cruz, suggested she had bought it in Sri Lanka and asked how much it cost her. Cruz says an officer also asked here why her surname was not Singh and commented that it was clever of her to use a Spanish name. Cruz, who is separated from her husband, says she told the officers that her maiden name is Fernandez. It is not uncommon for Indian-born people to have Portuguese surnames, but the officers did not seem to care, she says. They said, You better tell the truth because we know this is not a valid Canadian passport. Well throw you in jail, Cruz recalled. An officer, she says, held the passport up to a light on the ceiling, flipped through pages and said there were chemicals on it that indicated it was fake. Whats odd, says Cruz, is that the passport hadnt been doubted when she was leaving Toronto, via the U.S., for India, and on previous trips to Boston, New York and Spain. Cruz says she tried to show the officers other identification she had in her purse, but they werent interested. I was trying to explain to them, but they didnt want to listen to anything, they didnt want to see anything. As many as five INS officers were involved in the questioning, said Cruz. They just gave me two options: end up in jail (and wait several days to speak with Canadian officials) or take the flight. I pleaded with them to get in touch with the Canadian embassy, or if I could make a call, and they said no. She says she was hurried on to a flight destined for India, via Kuwait. The captain of the Kuwaiti Airlines flight had been handed her altered passport by American officials and, mid-flight, asked Cruz what had happened. The INS, which Cruz felt would make it difficult for her to even re-enter India, also stamped her valid Indian visa. The pilot agreed she could not go back to India with a destroyed passport and told her he would take care of the mess once on the ground in Kuwait. He was very, very helpful. Cruz spent three days in Kuwait City while Canadian officials at the Dubai consulate sorted out the mess and issued an emergency passport. When Cruz didnt arrive home and missed work, her family in India and Toronto became worried and, without knowing what had happened, a family member told her boss that she was sick. Two days later, the pilot who helped Cruz had his daughter phone Cruzs Employer to tell them what had happened. But with two different stories, and no word from Cruz herself, her employer took her off payroll and assigned her desk to someone else. The work problems have since been sorted out, although she did not want to name the bank she works for. But, Cruz says she hasnt found a way to deal with the range of emotions shes now feeling. Its really hard. I cant get to sleep at nights, she said. I cant really do anything. Its been a week since I really cooked for the kids. Cruz says she wants the Prime Minister to speak out publicly about the Incident in the hope other Canadian citizens do not receive similar treatment. Its horrible. It was humiliating, said Cruz. Albert E. Brooke, 51, of Allentown, fired Carbon County public defender William Schwab at his hearing Wednesday. Schwab still attempted to stop the hearing by telling District Justice Paul Hadzick that Brooke should have an evaluation to determine his competency. Hadzick allowed the hearing to continue and Brooke refused to heed hastily written notes from his former lawyer urging him, "Don't take the stand" and "Take the Fifth (Amendment)." A woman, now 18, testified Brooke molested her when she was 5 and 6. A boy, now 14, testified that Brooke molested him when he was 4 and 5. "We're not getting nowhere," Brooke said after prosecutor David Addy successfully objected to most of his questions posed to the now-teenagers. "I move for a mistrial." "When you're at a trial, you can move for a mistrial," Hadzick replied. "Then I move for a mishearing," Brooke said. Prompted by a question from Brooke, the boy described Brooke's penis as white in color. "My penis is not white," said Brooke, who then offered to show it to Hadzick in the bathroom. The district justice declined. Hadzick also refused Brook's requests to dismiss the charges based on "cruel and unusual punishment" and "attempted murder." Brooke said he has a host of illnesses and isn't getting proper medical care in prison. But the Union County youngster knew she'd probably be the only student with "no" written on the permission slip to attend a tent revival during school hours. When she declined to portray Mary in a Christmas play, she also was sent to the principal's office. India and her parents, Greg and Sarajane Tracy, allege other students taunted her, beat her and ridiculed her religion for years. Fed up with the treatment, her parents filed a federal lawsuit on her behalf Thursday. The lawsuit claims the Union County school system violated India's civil rights by promoting and endorsing religious activities, denied her right to freely exercise her religion and failed to protect her from harassment and physical and verbal abuse. The first time the Tracys declined to allow their daughter to attend the two-hour, fundamental Christian services held over three days was in 1999, when she was in the fourth grade. The family had bought 11 acres in Union County because they thought the area was beautiful. "The principal had called me to the office because mine was the only slip that said no," said India, now 14. "He asked me why I didn't want to go. He asked my religion. I told him I didn't want to talk about it and for him to call my parents." Sarajane Tracy told the principal that she also did not want to discuss religion because she didn't think it belonged in school, she said. The family could be anything - Buddhist, Jewish or Islamic - and it shouldn't matter, she said. The family follows the ancient religious tradition of Paganism, which embraces kinship with nature, positive morality and acknowledges both the female and male side of Deity, according to the Pagan Federation. India was the only student left in her class during the Area Wide Crusade in April 1999, so her classmates knew she hadn't gone. The crusade was begun in 1998 by a Union County Baptist pastor and is planned for this April as well. While declining to comment on the lawsuit, school system Director James Pratt said the ministry rents school buses for transporting the students and some teachers act as chaperones but they must use a personal day to do so. He referred other questions to Nashville attorney Charles Cagle. Cagle declined comment because he had not seen a copy of the lawsuit Thursday afternoon. The name-calling and rumor spreading began soon after the 1999 revival, India and her parents said. Between 1999 and February 2002 when her parents removed her from Horace Maynard Middle School, the lawsuit alleges: * That India was repeatedly called "Satan worshipper," "witch" and other derogatory names. She was accused of eating babies and of being a lesbian because she wasn't a Christian, the lawsuit said. * That India was forced to attend regular Bible study classes during the school day, and urged to lead the school and her class in prayer. * That India was repeatedly attacked as she knelt in front of her bottom-row locker. Her head was bashed at least 10 times, cutting her lip, above her eyes and bloodying her nose. * That a teacher told India to "keep quiet because you'll get in trouble" after she wrote a paper about religious freedom. * That a bus driver regularly asked India in front of other students if she had gone to church yet and if she'd like to come to church. The Tracys' Knoxville attorney, Margaret Held, said the family did not want to sue. They just wanted their daughter to attend a safe school without persecution. "They tried being quiet about it and that didn't work," she said. "I would hope that the people in Union County who have been killing their goats and beating up their kid are a minority. If there's one thing that Christ taught, it was tolerance." WASHINGTON - A national system to prescreen air travelers for security risks could start by year's end, despite privacy concerns. The Transportation Security Administration awarded a $12.8 million contract Friday to Lockheed Martin Corp. to link commercial databases, such as credit histories, with airline travel data and government terrorist watch lists. The idea is to use the information to assign a risk level -- green, yellow or red -- to all travelers before they get to the airport. Those with higher risk levels would get extra scrutiny, which the TSA says would lead to more effective security. Later this month the TSA plans to test the concept on Delta Air Lines travelers at three mid-sized airports -- which would not include Hartsfield International. Depending on how the test goes, the TSA plans to field the system elsewhere later this year. Each passenger will have to give full name, address, phone number and date of birth at the time of booking. The procedure is drawing criticism from privacy groups. The TSA screening program will subject travelers to unconstitutional "searches" without probable cause, said Mihir Kshirsagar, a policy analyst with the Electronic Privacy Information Center in Washington. The organization is suing the TSA to get an explanation of how a traveler is placed on a government watch list. The TSA hasn't filed a response. Opponents of the procedure say profiling will invade privacy without necessarily enhancing security because sophisticated terrorists will tailor their behavior to make themselves appear harmless. The new system, called Computer-Assisted Passenger Pre-Screening II, or CAPPS II, will search several databases the moment a passenger buys a ticket. At the airport a traveler's risk level will be encrypted on the boarding pass. Airport screeners will use machines to see the code. Green means the passenger gets the usual screening. Yellow means more attention, such as hand searches, removal of shoes and an explosive trace detection swab of carry-on luggage. Red means "you don't fly," said Chet Lunner, spokesman for the U.S. Department of Transportation. Most likely the passenger would be detained or arrested, Lunner said. "These are known foreign terrorists," he said. Lunner downplayed concerns over privacy invasion. "We're using existing technology and existing databases," Lunner said. "CAPPS II doesn't have any new power on its own to create investigations or go snooping around." The system will scan the kinds of databases that credit card companies and mortgage brokers use to run checks on customers making a big purchase, he said. The TSA doesn't care if a traveler has bad credit, Lunner said, it just wants to know if the person is established. For example, the address a traveler gives could be verified through credit history. "It's not so much to see what your credit rating is, but that you have one," Lunner said. "Those things back up your identity and help the system confirm that you are who you say you are." Kshirsagar warned that information contained in financial databases is often inaccurate. And storing private information in a central location could subject air travelers to a greater risk of identity theft at the hands of a hacker or dishonest employee. Lunner, the transportation department spokesman, said only TSA employees with special security clearances will have access to passenger information. CAPPS II would keep some fliers' information on file for up to 50 years. "Obviously we want a permanent record of terrorists as long as they present a threat," Lunner said. "We want to make sure the Mohamed Attas of the world stay on the list." Filed Feb. 19 in Santa Clara County Superior Court, Burnett's suit also claims he suffered spinal and neck injury when Sara McBurnett's car bumped his on a rainy night in February 2000. It was then that an enraged Burnett sprang from his sport-utility vehicle to confront McBurnett. When she rolled down her window to apologize, he reached inside, grabbed the dog named Leo and tossed him into oncoming traffic, where he was fatally struck. The sudden act of violence generated international headlines, which Burnett is blaming on the Mercury News and McBurnett to the tune of more than $1 million. Told of the lawsuit Wednesday, McBurnett was outraged. His attorney "must be a weasel," McBurnett said. Turns out, Burnett is representing himself. He filed the suit from the Sierra Conservation Center, the prison to which he was sentenced for the three-year maximum in July 2001. In the complaint, Burnett claims McBurnett tried to hide the extent of damage to her car, supposedly to make the fender-bender less dramatic than it was and minimize the possibility of his injuries. He also accused her of saying defamatory things about him to the media. And he blames the Mercury News for ``knowingly and maliciously'' printing such libel. Because of all this, the suit claims that Burnett has suffered, among other things, "mental pain and anguish, humiliation, embarrassment, fright and shock, and mortification."
