Fielding an error ?

Hello again blmlists. Came back after several years of arbitral inactivity.

 

And immediately, a delicate problem.

 

North is an expert ; South a client, prone to forgetting his system.

a.	Is there such a thing as fielding a system error ?
b.	In this case, would you deem it to (possibly) have happened here ?
c.	What do active ethics say about this situation ?

 

(notice that NS can make 5C, except that the client would play it (after
2NT-3C etc.)
