The 2007 and 2017 Lawbooks make it clear that there is no such animal as ”fielding” and/or “Rule of Coincidence”.

Instead Law 40C1 states:

“...Repeated deviations lead to implicit understandings which...must be disclosed...”

The client’s frequent forgetfulness has created an implicit understanding, so therefore the opponents should have been given timely disclosure.

In this case East-West were damaged, as they could have competed for the partscore in hearts.
