There is such a thing, but it isn't an infraction unless based on UI.

You need to ask North why he passed, but there is suspicion that he 
expected South to have forgotten the agreement.  If so, failing to 
mention that in the explanation was MI with all the usual consequences. 
I suppose it's possible that North was just gambling that the unknown 
diamond fit would play better than the presumed 5-1 heart fit.  It might 
be helpful to poll other experts to see whether any of them pass, but 
ultimately you are going to have to judge the balance of the evidence.

On a good day for you, the MI will have done no damage, and you won't 
have to judge whether it existed or not.
