It is a key part of Jay’s job to be sure and to consult with counsel and the LLC board (and the board to also consult with counsel). I know for a fact that consultation with legal counsel has occured; aside from my personal knowledge, it is documented in IETF LLC meeting minutes. In particular I will note that recent IETF LLC minutes have noted that so much consultation has been needed that legal costs have exeeded the time budget of the fixed fee agreement and will cost the IETF more money.

If you do not agree with the legal opinion rendered by counsel for the IETF, I may suggest that email discussion is less useful than direct discussion with the IETF LLC board - in which case join an upcoming board call and hear directly from them.
