POSIX compliance: pthread_mutex_destroy()

hello,

I am working on the Open POSIX Test Suite project at
http://posixtest.sourceforge.net
I ran the POSIX compliance tests upon 

ngpt-2.2.0
kernel-2.4.18
glibc-2.2.93-5

There seemed to be an error in the function pthread_mutex_destroy(), where
the test failed because pthread_mutex_destroy() did not successfully destroy
a mutex initialized using PTHREAD_MUTEX_INITIALIZER, it instead returned
EINVAL (22).

The test that I am using to reproduce this issue is part of the POSIX Test
Suite project http://posixtest.sourceforge.net under
posixtestsuite/conformance/interfaces/pthread_mutex_destroy/1-1.c  (pasted
the code below)

Error message received was: "Fail to destroy mutex3, rc=22"
