I'm not aware that RHEL is restricting *any* GPL code, source or object, 
from distribution.  My understanding is that the RHN subscription 
license agreement is the restriction and that Red Hat will not provide 
any support, either through patches, service calls, etc. to any system 
that does not have a RHN subscription.

I'm guessing the reason Red Hat provides only SRPMS is to restrict 
building RHEL to only those competant enough to do so, and so far few of 
those people have seen a need to turn those SRPMS into RPMS and make 
them freely available.  Of course any other non-GPL software distributed 
with RHEL (like the JDK I *think* it includes) is covered by its own 
license and subject to terms in that.
