Right. And more importantly - if you don't protect your property then
the courts consider that you do not want to protect it. The old
principle of 'owners of expensive racehorses must keep good fences'. If
djb fails to actively protect his intellectual property in qmail then
the courts will not consider that property to be valulable if he should
later try to protect it.
