There are also NO rights given on the site for you TO use it or copy it
for your use. The default rights of any 'work' is that it is copyright
(which, duh, means you CAN'T have the RIGHT to COPY it).

Unless djb gives you the right to own it or copy it then you may not
copy it. 

Where does he say you can copy it for your own use? He DOES give rights
to 'distribute' it, but the normal definition of distribute EXCLUDES the
right to 'use'. (Imagine a distributor of refrigerators that took each
one home to 'use' before he 'distributed' it - that wouldn't impress
many people. 

Boss: Why did you use the refigerators before you sold them? 
JoeIdiot: I was just distributing them. 
Judge: Yeah right, Have 5 years.

Ho, ho ho. IBM instructs it's webservers to give us copies of pages, so
you can copy them and make your own ibm web site and like, they won't
sue you? Or if they do, you can wave a copy of 17 USC 117 at their 101
lawyers and expect to come away successful. Like you even have TIME to
sit in a courtroom for 1000 days while each of their lawyers argues the
case and all the time you sit there and say 'I'm right, I'm right',
meanwhile your business dies, your family moves away and your friends
ignore you.

Or someone's kazzaa peer gives you a copy of a song and so you have the
right to 'use' it. ROFL. 

djb does not give you the right to own a copy of of qmail and therefore
every copy you download is pirated.
