To be fair I can see where you are going with it, but I think it trivializes murder. IIRC the original point was that the death penalty is a consequence to committing the crime of murder. But for the murder there would be no death penalty, (just to be clear, for discussion purposes I'm talking about unequivocal guilt cases), so it is rather easy to avoid.
