I dunno, it seems to be part of the opposition parties job, to cast
aspersions on the president, count the ways he deserves impeachment, his war
crimes, etc, etc, etc.

I consider the possibility. But mostly I see it as searching for a
technicality to make him appear illegitimate, much as many Dems considered
Bush's first term to be.
