The helmet cam video clearly disputes that.

I speak in no way of justifying the raid or his death.  But one initial
thought is that with sirens blaring outside and police identifying
themselves loudly, it is an act of stupidity to arm yourself.   

I also want to point out that fact he had not shot and the gun was on safety
is not relevant, nor is his being a Marine.  That fact he was holding it did
make him a threat and in many other settings if a police officer saw a man
holding a weapon there would be justification for deadly force.


The real issue we should be debating is why his home was selected for a raid
in the first place, because that element is the primary point of failure if
he had no drugs or money.  In almost all of the cases I have been reading
about that has been a huge factor.

There is clearly a failure here and cover up underway:

"They have obtained a court order sealing the search warrants and police
affidavits that led to the raids, and they're now refusing any further
comment on the case at all. When I contacted Public Information Officer
Jason Ogan with some questions, he replied via email that the department
won't be releasing any more information. On Saturday, Pima County Sheriff
Clarence Dupnik told Arizona Daily Star columnist Josh Brodesky that he may
never release the search warrants and police affidavits."

The secondary failure (aside from the shooting) was refusal to allow
paramedics in, assuming this is true:

"After ushering out his wife and son, the police refused to allow paramedics
to access Guerena for more than hour, leaving the young father to bleed to
death, alone, in his own home."

That is bullshit.  The justification of "there could be other shooters" is
crap.  It would not have taken them more than a few minutes to clear the
house.

One caveat,  I do not trust all of the huffpo story information and I have
not verified any of this independently,  but if it is true, I see a huge
civil suit coming and from all indications, a justified one.

I posted the story about this a week or so ago.  This is some helmet cam
video of the incident.  Notice how the one goon in the back rushes up to
shoot his pistol into the open door over the shoulder of the other thugs,
(yes I'm using loaded terms - they fit).  He just had to get his shots in -
shots he is taking into a home without seeing what he is shooting at.  It
typifies the whole thing.  Yes, the marine had a rifle in his hands, but he
did not fire a shot and the gun was on safety. 


We can talk about all the banking, political, international stuff we want
to, but if this kind of thing is allowed to continue we are fucked.  We
aren't free people anymore, merely tolerated ones.  This fills me with equal
amounts of despair and rage.
