Yes, very scary. The IM space is being locked up by patents very
quickly but it isn't the only space with a similar problem. For
instance, there are currently 372 patent applications that contain the

The most important thing to do here is to keep up to date on new
patents and new applications. It is *very* important to keep up to date
on new applications since there is a tiny, two-month window during which
third-parties are able to submit prior art to the PTO that will be
considered in the patent granting process. This is a relatively new
thing in the patent law and finally gives the public a means to stop bad
patents *before* they issue. I would suggest that we should all
carefully watch the weekly publication of new applications and then,
when appropriate, organize efforts to get prior art submitted to the PTO
in an effort to stop the more ridiculous applications from ever having a
chance.=20
Applications seem to be published on Thursday of every week. Today,
for instance, another 16 were published. I've included a list below of
links to these 16. Please, let's have everyone who cares about Instant
Messaging comb through these and see if there are any problems.
Remember, the time period for third-party submission of prior art lasts
only two months from the date of publication. Once that window is
closed, all we can do is wait to see if the patent is issued. Fighting
issued patents if vastly more expensive than preventing patents from
being issued...
