annoying kernel message

Hi all!

We are running TUX ( compiled into RH 2.4.18-18 kernel) for web serving 
static content.
It boosted our webserwer to the sky :)
But there are some annoying messages in syslog :

 kernel: KERNEL: assertion (newsk->state != TCP_SYN_RECV) failed at tcp.c
(2229)
 kernel: KERNEL: assertion ((1<<sk2->state)&
(TCPF_ESTABLISHED|TCPF_CLOSE_WAIT|TCPF_CLOSE)) failed at af_inet.c(689)

Why is that ?
(I've changed some tcp params  - maybe I shouldn’t or should change some 
more)
