unlicensed WiMAX on hold?

There is some talk from reliable sources that we are still at least 1 year + from unlicensed fixed WiMAX. My understanding is that the current 16d specs wont work in unlicensed and we may have to wait for a standard called 16h (yes h) to use fixed WiMAX unlicensed gear. anybody got anymore info on this?
