I'm not sure that clearing up the ambiguity about criminality will
address the spam problem at all. Our justice system has other
priorities, unfortunately.

Personally, what I'd like to see are civil awards that people can claim
from spammers.

More explicitly:

- spammer A spams you.
- you take A to small claims court (SCC), needing to prove on a balance
of probabilities that they sent you a spam message.
- this entitles you to get an award for RX per message via SCC award,
with an increasing sliding scale if the spam is received after a
previous SCC award - meaning that it will eventually be worth your while
to enforce the judgement in civil court.

Sure - the above may require some work on the spammed's part, but I
think it has more chance of stopping (local) spam than any other idea
I've seen floated.

(naturally - this ignores the global nature of spam)
