After all, you can just delete it with no additional cost other than a moment's irritation. If bulk mail senders / direct marketers only sent to those who opted-in (by choice to abide by a higher standard, not law!) and recipients simply deleted the stuff they didn't want to get, we'd still have a 'spam problem', and the powers that be would continue to consider it a benign problem.
