India is a signatory to TRIPS, and in short, it means that India has agreed
to accept some internationally accepted code-of-conduct regarding
Intellectual Property (patents in this case... and most cases).
International (read US based) pharma co. claims to have invested truckloads
of time and money in developing cancer drugs, for which it expects to earn
a healthy profit. They sold the drug in India, at costs which as per Indian
govt. very few Indians could afford to buy it. This being a life-saving
drug, India (SC in this case) went ahead and permitted Indian pharma
companies to sell the drug at much lower price points, while paying a
royalty to the co. which holds the patent. This way as per the US company,
they earn much less, than what they could have, had Indian public been
forced to buy the drugs at full international cost. This, as per the
redneck congressman, is against the spirit of TRIPS (and (sic.) perhaps the
concepts of capitalism).
