hi Andrew, In theory, an email header counts as a signature under UETA (http://en.wikipedia.org/wiki/Uniform_Electronic_Transactions_Act). So in the worst case, it probably would stand as a signature and indicate agreement as long as you can verify that the email address belongs to an individual. But since your clients would have to be comfortable with email as signature, perhaps you can point them to their counsel to ask about this.
