 PC and totallyungroundedcharges of abuse, constituted a major disaster and=
 hurt manypeople: UVA , Duke Lacrosse, and the Western polygamists.In all o=
f these, the alleged =E2=80=9Cabusers=E2=80=9D havebeen shown to be innocen=
t and victimized.There are other such cases as well.
None of this negates, of course, thefact that there are many cases indeed o=
f bona fide abuse which,as you note and I know, include many notknown broad=
ly.But the kind ofwitch-hunting approaches sometimes found in these situati=
ons constitute travestieson civil liberty and justice in general -- approac=
hes lacking careful priorinvestigation, often characterized by sloppy repor=
ting, sometimes marked by akind of hysteria, and featuring rushes to judgme=
nt with the burden of proof onthe accused.
I am sure that we both agree that nogood cause or purpose is thereby well s=
erved.
I will post all of this broadly.

a withRolling Stone retracting all and trying to apologize , I gave only tw=
oothers in my just sent message: the Duke Lacrosse matter where allcharges =
were dropped, the accused students totally cleared, and the prosecutingDist=
rict Attorney removed from office and then disbarred -- and thepolygamy cas=
e where the highest Texas courts stated they could no evidenceof abuse and =
ordered the several hundred children returned to theirparents, which was th=
en done.=20
As Irecall, you said in both instances that you had not followed those case=
s much,if at all -- although I posted a great deal on them. Infact, you -- =

I am not convinced by what Hunter writes on this topic. He lists a lot of c=
ases where he says his skepticism was right, but I have rarely been convinc=
ed by him or the press that we really know what happened. I come closest to=
 being convinced in relation to the Mormon ase.

I generally have little interest in media blow ups of these sorts that focu=
s on individual incidents, and tend not to put too much credence in it when=
 they "turn out to have been frauds." The media abound with lies and hipste=
rs trying to spin tales of innocence and guilt. Sometimes these issues are =
important, like the Scottsboro case or, on another more contemporary case, =
the Fort Lee case, as a couple of clear examples. But we almost never get a=
 definitive solution to them, though the media often claim they dug out the=
 truth.


These are the same media who assured us there were WMD in Iraq, and lie on =
so much else, or let themselves be fooled, as when they report what the pol=
ice say as having considerable truth value.


On this one, I will not get too involved, but would not take the reports Hu=
nter points to as definitive. This may be a situation where the administrat=
ive investigation by Teresa Sullivan et al. May be the most believable repo=
rt. Or not.


I am sure Hunter believes he is right in what he says. I respect him in man=
y ways, but I also tend to be skeptical of what some have termed "the spect=

 a story in Rolling Stone magazine charged that a young woman had been subj=
ected to gang rape at a fraternity houseat the University of Virginia.

The story, taken at face value by university authorities and most media, be=
came national and then global in scope. It quickly triggered a vilifying ru=
sh to judgment against the frat and its members, the house was summarily cl=
osed , then all frats were under suspicion -- and there were campus demonst=
rations against them and their members.

But it=E2=80=99s all turned out to be a fake.

CNN and MSNBC, which broadly carried the report, seem unhappy with this rev=
elation =E2=80=93 but do have to say something.But the best report on this =
travesty comes from Fox:

This is a case where unbridled =E2=80=9Cpolitical correctness=E2=80=9D ran =
amuck =E2=80=93 and a lot of people have been hurt. The term itself has alw=
ays disturbed me.It sounds like something emerging from a tiny and insular =
political sect, with its roots originally abroad, and which, unable and unw=
illing to engage tangible issues of substance, is turning its zeal against =
its own followers =E2=80=93 sort of like an auto-immune disease where one=
=E2=80=99s bodily immune system turns on itself.

I like to think in terms of good taste and good sense.

In the last 35 years or so, political correctness has pervaded much of the =
culture of this country.On the plus side, it has illuminated the often wide=
 parameters of a great many instances of social injustice.

On the negative side, it=E2=80=99s frequently used in cavalier fashion with=
 little regard to the actual, factual situation.And, for unscrupulous folks=
, it can be a tool of Machiavellian nature, well suited for careerism and p=
olitical campaigns.

And all of this wild and spurious dust and sandstorm stuff can confuse and =
obscure the many and very real instances of human injustice.

The Duke Lacrosse fraternity frame-up at Durham, N.C. a few years ago stemm=
ed from knee-jerk P.C.Still familiar with the social and political landscap=
e of that state where we lived for a number of years, I almost immediately =
knew that to be a frame-up.Eventually =E2=80=93 eventually =E2=80=93 that w=
as straightened out and the accused frat members were totally vindicated..H=

Not long after the Duke situation, a full scale witch-hunt against religiou=
s polygamists (fundamentalist Mormons unaffiliated with the mainline LDS ch=
urch), burst forth yet again. (These seem to occur about every half century=
 or so.)In this case, there were charges, via a few witnesses of very dubio=
us character, that women and children were being abused en masse.Arizona an=
d Utah moved, though cautiously, against the polygamist communities.But, in=
 West Texas, authorities seized several hundred children. Most American med=
ia had a field day playing up the abuse allegations.

I knew this to be a frame-up immediately.Perhaps alone on the myriad of e d=
iscussion lists, I had had contact a number of times, in northern Arizona a=
nd southern Utah, with polygamists and their small communities =E2=80=93 an=
d I knew them to be good people.After a number ofturbulent months, the Texa=
s appellate court ruled that it could find no evidence of child abuse whats=
oever and ordered the return of all of the polygamist kids to their familie=
s.This was upheld by the Texas Supreme Court.The children were returned and=
, although there are flare-ups now and then, the attacks on these peaceful =

In 1991, at the University of North Dakota, a move began to develop toward =
imposing a code banning =E2=80=9CHate Speech=E2=80=9D. Thoughtful faculty a=
nd students recognized the dangers to the First Amendment and academic free=
dom =E2=80=93 and some faculty were aware that such a code could be used fo=
r unscrupulous purposes in the UND setting which, to understate it, was bes=
et with internal problems.I wrote the letter that launched our successful c=
ampaign to kill the Hate Speech ban.

I'm completely against any efforts to ban racist or sexist speech, or any
other speech, on college and university campuses -- or anywhere else.

I speak as both activist and academic and as one who has been involved in
social justice pursuits and teaching since the mid-1950s.

American Indians have traditionally recognized the right of everyone to be
heard -- no matter how unpopular or even noxious the verbiage. Whatever
its many limitations, my native state of Arizona has never deteriorated --
despite the presence of the copper bosses and the farming magnates, among
others -- into the sort of closed society once exemplified by Mississippi.
In part, at least, this has been because of the libertarian traditions of a
far-ranging frontier where "things open out instead of in" and where free
speech has generally, however grudgingly, been respected or at least
tolerated.

I've never known any effort anywhere to ban speech that really "worked."
I've known few such efforts that, sooner or later, weren't turned against
the advocates of constructive social change. Hell, look at human history.

Frankly, some of the most sanctimonious proponents of suppression of racist
and sexist speech in university settings have been, in my observation,
administrators whose real commitment to, say, affirmative action has been
Zero -- and who frequently have worked against anything of a tangible natur=
e
that would increase the numbers and morale of women and minorities in
meaningful positions. Other, more well meaning official folk, worry about
"negative speech," expressing their concerns in the context and style of a
prattling timidity that brings out the worst in everyone.

Here at the University of North Dakota, in a state and region where Native
Americans are the most substantial minority, our Department of American
Indian Studies offers several sections of a course called Introduction to
Indian Studies -- which fulfills a state teacher certification necessity an=
d
also meets certain humanities and social science requirements. About 350
students per year pass through these courses [I teach 200 or so personally]=
;
the majority are Anglo, with a good number of American Indians and other
minorities represented. In this classroom setting, academic dimensions are
heavily laced with confronting all kinds of people hang-ups and we deal wit=
h
these in a non-guilt-trip, "say what you please" hang-loose sort of
atmosphere.

This works -- and often these students go on to take other courses of ours,
such as Contemporary Indian Issues or Federal Indian Law and Policy or
Plains Indians. Common interests, common concerns, and common allies
surface.

And in many other sectors, in and out of the university setting, we
challenge all kinds of anti-people words and deeds and patterns. We've done
it openly and candidly -- and without tearing people down. Our efforts are
interracial and intercultural.

We've seen things improve enlightenment-wise with the students, considerabl=
y so, and with many townspeople. But we still have a long, long way to go i=
n getting minorities and women hired in solid and influential university po=
sitions. Academics -- including academic liberals -- are certainly often ha=
rder to deal with than an essentially nice Anglo kid who has some
hang-ups.

The kid is usually honest enough to face up and change, given a firm push o=
r
two or three -- done in a friendly fashion.

We just have to keep fighting, all of us together, step by step. But let's
not waste time on dangerous gimmicks like gag laws and regulations. The
real prize lies "over the mountains yonder" and we can catch it -- if we
don't allow ourselves to be de-railed and diverted into the canyons.

nt face=3D"Calibri">The story, taken at face value by university authoritie=
s and most media, became national and then global in scope. It quickly trig=
gered a vilifying rush to judgment against the frat and its members, the ho=
use was summarily closed , then all frats were under suspicion -- and there=
 were campus demonstrations against them and their members.<span class=3D"A=
pple-converted-space">&nbsp;</span></font></span></b></p><div><font face=3D=
"Times New Roman" size=3D"3"></font></div><p style=3D"margin: 0in 0in 8pt;"=

pan>But it=E2=80=99s all turned out to be a fake.</font></span></b></p><div=

al sect, with its roots originally abroad, and which, unable and unwilling =
to engage tangible issues of substance, is turning its zeal against its own=
 followers =E2=80=93 sort of like an auto-immune disease where one=E2=80=99=
s bodily immune system turns on itself.</font></span></b></p><div><font fac=

last 35 years or so, political correctness has pervaded much of the culture=

span></span>On the plus side, it has illuminated the often wide parameters =
of a great many instances of social injustice.<span class=3D"Apple-converte=
d-space">&nbsp;</span></font></span></b></p><div><font face=3D"Times New Ro=
man" size=3D"3"></font></div><p style=3D"margin: 0in 0in 8pt;"><b><span sty=
le=3D"font-size: 12pt;"><font face=3D"Calibri"><span>&nbsp;</span>On the ne=
gative side, it=E2=80=99s frequently used in cavalier fashion with little r=
egard to the actual, factual situation.<span>&nbsp;<span class=3D"Apple-con=
verted-space">&nbsp;</span></span>And, for unscrupulous folks, it can be a =
tool of Machiavellian nature, well suited for careerism and political campa=
igns.</font></span></b></p><div><font face=3D"Times New Roman" size=3D"3"><=
/font></div><p style=3D"margin: 0in 0in 8pt;"><b><span style=3D"font-size: =
12pt;"><font face=3D"Calibri">And all of this wild and spurious dust and sa=
ndstorm stuff can confuse and obscure the many and very real instances of h=
uman injustice.</font></span></b></p><div><font face=3D"Times New Roman" si=

ri"><b><span style=3D"font-size: 12pt;">The Duke Lacrosse fraternity frame-=
up at Durham, N.C. a few years ago stemmed from knee-jerk P.C.<span>&nbsp;<=
span class=3D"Apple-converted-space">&nbsp;</span></span>Still familiar wit=
h the social and political landscape of that state where we lived for a num=
ber of years, I almost immediately knew that to be a frame-up.<span>&nbsp;<=
span class=3D"Apple-converted-space">&nbsp;</span></span>Eventually =E2=80=
=93 eventually =E2=80=93 that was straightened out and the accused frat mem=
bers were totally vindicated..<span>&nbsp;<span class=3D"Apple-converted-sp=

g after the Duke situation, a full scale witch-hunt against religious polyg=
amists (fundamentalist Mormons unaffiliated with the mainline LDS church), =
burst forth yet again. (These seem to occur about every half century or so.=
)<span>&nbsp;<span class=3D"Apple-converted-space">&nbsp;</span></span>In t=
his case, there were charges, via a few witnesses of very dubious character=
, that women and children were being abused en masse.<span>&nbsp;<span clas=
s=3D"Apple-converted-space">&nbsp;</span></span>Arizona and Utah moved, tho=
ugh cautiously, against the polygamist communities.<span>&nbsp;<span class=
=3D"Apple-converted-space">&nbsp;</span></span>But, in West Texas, authorit=
ies seized several hundred children. Most American media had a field day pl=
aying up the abuse allegations.</font></span></b></p><div><font face=3D"Tim=
es New Roman" size=3D"3"></font></div><p style=3D"margin: 0in 0in 8pt;"><b>=
<span style=3D"font-size: 12pt;"><font face=3D"Calibri"><span>&nbsp;</span>=
I knew this to be a frame-up immediately.<span>&nbsp;<span class=3D"Apple-c=
onverted-space">&nbsp;</span></span>Perhaps alone on the myriad of e discus=
sion lists, I had had contact a number of times, in northern Arizona and so=
uthern Utah, with polygamists and their small communities =E2=80=93 and I k=
new them to be good people.<span>&nbsp;<span class=3D"Apple-converted-space=
">&nbsp;</span></span>After a number of<span class=3D"Apple-converted-space=
">&nbsp;</span><span>&nbsp;</span>turbulent months, the Texas appellate cou=
rt ruled that it could find no evidence of child abuse whatsoever and order=
ed the return of all of the polygamist kids to their families.<span>&nbsp;<=
span class=3D"Apple-converted-space">&nbsp;</span></span>This was upheld by=
 the Texas Supreme Court.<span>&nbsp;<span class=3D"Apple-converted-space">=
&nbsp;</span></span>The children were returned and, although there are flar=
e-ups now and then, the attacks on these peaceful people have ended =E2=80=
=93 for the time being.<span>&nbsp;<span class=3D"Apple-converted-space">&n=

ld be used for unscrupulous purposes in&nbsp;the UND&nbsp;setting which, to=
 understate it, was&nbsp;beset with internal problems.<span>&nbsp;&nbsp;<sp=
an class=3D"Apple-converted-space">&nbsp;</span></span>I wrote the letter t=
hat launched our successful campaign to kill the Hate Speech ban.</font></s=

er speech, on college and university campuses -- or anywhere else.<br><br>I=
 speak as both activist and academic and as one who has been involved in<br=
>social justice pursuits and teaching since the mid-1950s.<br><br>American =
Indians have traditionally recognized the right of everyone to be<br>heard =
-- no matter how unpopular or&nbsp; even noxious the verbiage.&nbsp; Whatev=
er<br>its many limitations, my native state of Arizona has never deteriorat=
ed --<br>despite the presence of the copper bosses and the farming magnates=
, among<br>others -- into the sort of closed society once exemplified by Mi=
ssissippi.<br>In part, at least, this has been because of the libertarian t=
raditions of a<br>far-ranging frontier where "things open out instead of in=
" and where free<br>speech has generally, however grudgingly, been respecte=
d or at least<br>tolerated.<br></span><br></font></font><font face=3D"Calib=
ri"><font size=3D"3"><span>I've never known any effort anywhere to ban spee=
ch that &nbsp; really "worked."<br>I've known few such efforts that, sooner=
 or later, weren't turned against<br>the advocates of constructive social c=
hange.&nbsp; Hell, look at human history.<br><br>Frankly, some of the most =
sanctimonious proponents of suppression of racist<br>and sexist speech in u=
niversity settings have been, in my observation,<br>administrators whose re=
al commitment to, say, affirmative action has been<br>Zero -- and who frequ=
ently have worked against anything of a tangible nature<br>that would incre=
ase the numbers and morale of women and minorities in<br>meaningful positio=
ns.&nbsp; Other, more well meaning official folk, worry about<br>"negative =
speech," expressing their concerns in the context and style of a<br>prattli=
ng timidity that brings out the worst in everyone.<br></span><br></font></f=
ont><font face=3D"Calibri"><font size=3D"3"><span>Here at the University of=
 North Dakota, in a state and region where Native<br>Americans are the most=
 substantial minority, our Department of American<br>Indian Studies offers =
several sections of a course called Introduction to<br>Indian Studies -- wh=
ich fulfills a state teacher certification necessity and<br>also meets cert=
ain humanities and social science requirements.&nbsp; About 350<br>students=
 per year pass through these courses [I teach 200 or so personally];<br>the=
 majority are Anglo, with a good number of American Indians and other<br>mi=
norities represented.&nbsp; In this classroom setting, academic dimensions =
are<br>heavily laced with confronting all kinds of people hang-ups and we d=
eal with<br>these in a non-guilt-trip, "say what you please" hang-loose sor=
t of<br>atmosphere.<br><br>This works -- and often these students go on to =
take other courses of ours,<br>such as Contemporary Indian Issues or Federa=
l Indian Law and Policy or<br>Plains Indians.&nbsp; Common interests, commo=
n concerns, and common allies<br>surface.</span><br><br></font></font><span=
><font face=3D"Calibri" size=3D"3">And in many other sectors, in and out of=
 the university setting, we<br>challenge all kinds of anti-people words and=
 deeds and patterns.&nbsp; We've done<br>it openly and candidly -- and with=
out tearing people down.&nbsp; Our efforts are<br>interracial and intercult=
ural.<br><br>We've seen things improve enlightenment-wise with the students=
, considerably so,&nbsp; and with many townspeople.&nbsp; But we still have=
 a long, long way to go in getting minorities and women hired in solid and =
influential university positions.&nbsp; Academics -- including academic lib=
erals -- are&nbsp; certainly often harder to deal with than an essentially =
nice Anglo kid who has some<br>hang-ups.<br><br>The kid is usually honest e=
nough to face up and change, given a firm push or<br>two or three -- done i=
n a friendly fashion.<br><br>We just have to keep fighting, all of us toget=
her, step by step.&nbsp; But let's<br>not waste time on dangerous gimmicks =
like gag laws and regulations.&nbsp; The<br>real prize lies "over the mount=
ains yonder" and we can catch it -- if we<br>don't allow ourselves to be de=
